1. Introduction and Acceptance

Welcome to Luminary Leads Pvt. Ltd. ("Company," "we," "our," or "us"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Luminary Leads, governing your use of our website www.luminaryleads.com.np and all related services. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services. Applicable Law: β€’ Nepal: Companies Act 2063, Foreign Employment Act 2064 β€’ EU Countries: GDPR, Consumer Protection Laws β€’ Other Jurisdictions: Local employment and data protection laws These Terms are available in multiple languages. In case of conflict, the English version prevails.

2. Services Description

Luminary Leads provides comprehensive international recruitment services: Core Services: β€’ International job placement (Poland, Romania, Croatia, Japan, Korea, Dubai, Malaysia) β€’ Candidate screening and verification β€’ Visa and work permit assistance β€’ Pre-departure orientation β€’ Post-placement support β€’ Skills assessment and training coordination Service Limitations: β€’ We are facilitators, not employers β€’ Job placement is subject to employer approval β€’ Visa approval depends on immigration authorities β€’ We do not guarantee employment outcomes Prohibited Uses: β€’ Providing false information or documents β€’ Attempting illegal immigration β€’ Human trafficking or exploitation β€’ Circumventing legal employment channels

3. Eligibility and Registration

Eligibility Requirements: Job Seekers: β€’ Minimum age: 18 years (21 for certain countries) β€’ Valid passport with 6+ months validity β€’ Clean criminal record β€’ Medical fitness for intended work β€’ Educational/skill qualifications as required Employers: β€’ Registered business entity β€’ Valid operating licenses β€’ Compliance with local labor laws β€’ Financial capability to employ foreign workers Registration Process: β€’ Complete online application with accurate information β€’ Upload required documents (authenticated where necessary) β€’ Verification may include background checks β€’ Account approval at our sole discretion False Information: Providing false information will result in immediate termination and may be reported to authorities.

5. Fees, Payments, and Refunds

Fee Structure: Job Seekers: β€’ Registration: Free β€’ Job matching: Free β€’ Document processing: At cost β€’ Premium services: As advertised β€’ NO placement fees charged (employer pays) Employers: β€’ Recruitment fee: Based on position and location β€’ Success fee: Upon candidate joining β€’ Retention guarantee: 3-6 months replacement Payment Terms: β€’ All fees quoted in local currency β€’ Payment via bank transfer, card, or approved methods β€’ VAT (13%) and applicable taxes additional β€’ Late payment: 2% monthly interest Refund Policy: β€’ Registration fees: Non-refundable β€’ Service fees: Pro-rata refund if service not delivered by us β€’ Visa rejection by Embassy: - Documentation preparation fees: NON-REFUNDABLE - Embassy fees: NON-REFUNDABLE (paid directly to embassy) - Our service charges: Partial refund (case-by-case basis) - Re-application support: 50% discount on service fees β€’ Candidate withdrawal: No refund after document submission β€’ Embassy policy changes: No refunds β€’ Force majeure: No refunds for circumstances beyond control NOTE: Visa approval is at embassy's sole discretion. We cannot guarantee visa approval and fees paid for documentation and processing are non-refundable regardless of visa outcome.

6. Rights and Responsibilities

Your Responsibilities: Job Seekers: β€’ Provide truthful, complete information β€’ Maintain confidentiality of employer information β€’ Honor employment contracts once signed β€’ Comply with immigration laws β€’ Report any issues promptly β€’ Attend required training/orientation Employers: β€’ Provide accurate job descriptions β€’ Comply with labor laws and standards β€’ Ensure safe working conditions β€’ Pay agreed wages timely β€’ Provide stated benefits β€’ Not discriminate illegally Our Rights: β€’ Verify all information provided β€’ Reject applications without stating reasons β€’ Modify service offerings β€’ Suspend accounts for violations β€’ Share information with authorities when required β€’ Charge for additional services Intellectual Property: All content on our platform is protected. You may not copy, distribute, or create derivative works without permission.

7. Data Protection and Privacy

9. Dispute Resolution

Governing Law: These Terms are governed by the laws of Nepal, without regard to conflict of law principles. Dispute Resolution Process: 1. 11. Term and Termination

Term: These Terms are effective upon your acceptance and continue until terminated.
